TeddyBearClicks Terms Of Service
YOU MUST BE ABLE TO READ ENGLISH
AND UNDERSTAND THESE TERMS
Failure to understand these Terms says to me that you cannot read english and therefore - you are in violation.
By signing up and actively using the
TeddyBearClicks program you agree to all terms and conditions set forth in this agreement.
TeddyBearClicks may, at any time, choose to edit, add and/or delete portions of this agreement
and impose changes without prior notification of its affiliates. Affiliates will
be informed of any and all changes to this policy. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the
TeddyBearClicks program following our posting of a change in policy notice or new agreement on
our site will constitute binding acceptance to the change.
COUNTRY RESTRICTIONS:
***Due to the Foreign Assets Control Policy in the U.S.***
We will not accept members or payments from the following countries: Angola, Burma, Cote d'Ivoire, Cuba, Iran, Iraq, Liberia, Libya, North Korea, Sierra Leone, Sudan, Syria, Western Balkans (Bosnia & Herzegovina, Albania, Macedonia, Serbia (including Kosovo) and Zimbabwe.
AS OF MARCH 1, 2011 all Tier 3 & 4 country members will only be allowed to redeem for advertising. NO CASH PAY OUTS will be made to any member who is not from one of the countries listed at the top of this page UNLESS you are already a PAID UPGRADED member.
RESPONSIBILITY OF AFFILIATES:
You must be 18 years of age or older to participate in this program. Our program
is open to both US and International affiliates and is void where prohibited by
local governing laws.
You agree to and must use your own name, home address and e-mail address in the sign-up process
and may not assume a false identity. You may not sign-up multiple times with different
e-mail addresses. Your computer must not be shared with another individual that
has an existing
TeddyBearClicks account.
You will use your e-mail address / password combination to access your account,
it is your responsibility to keep this information confidential, you may change
this information by logging into your account and following the "User Account
Info." link.
You are solely responsible for any and all use of your
TeddyBearClicks account including authorization by you to any third party individual who may use
your account.
Should any instances of fraud, system abuse, or any type of activity deemed to
be inappropriate or illegal by
TeddyBearClicks be detected it may result in member termination and possible legal action. Any
solicitation of advertisers for a confirmation e-mail for purposes of receiving
credit in your account will be grounds for immediate termination.
You must maintain your e-mail account that you used when signing up with
TeddyBearClicks. You agree to receive e-mail advertising from
TeddyBearClicks. limited to no more than (100) per day.
In the event your e-mail account on file becomes closed or blocked to messages
from
TeddyBearClicks, your account will be terminated. This especially applies to e-mail accounts
returned for being Full. Any member sending us gibberish will result in automatic
termination of account and Forfeiture of All earnings to date of termination.
Auto-responses will also be deleted immediately.
The free upgrade is available to any new member who joins the site not including those who join as an advertiser instead of an affiliate. The free upgrade must be requested within the first 30 days of joining, as it will no longer be available after that.
ACTIVITY REQUIREMENTS:
**ADVERTISERS NEED YOUR CLICKS**
-- Free members must click a minimum of 5 clicks within one week of signing up to activate their account. then they must click a minimum of 50 links every calendar month (any combination of email, ptc..etc)with the minimum time set between clicks to be at least the minimum as set per ad and have $0.10 in personal earnings for each $1.00 in downline earnings in order to request payout. Only members from tier 1 & 2 countries may request cash out. Members from Tier 3 & 4 countries must have a paid upgrade in order to request a cash out.
-- All other members (including free upgraded members and program owners) must click a minimum of 100 clicks every calendar month (any combination of email, ptc..etc)with the interval between clicks being at least the minimum set for each ad and have $0.10 in personal earnings for each $1.00 in paid to promote, affiliate page, and downline earnings in order to request payout.
-- All members must remain active and click(any combination of email, ptc..etc)every 30 days. Accounts that fall into an inactive status will be terminated after 30 days unless members account is otherwise noted(vacation time set, etc.) NO EXCEPTIONS!
***Beginning Dec. 1, 2010 Members using upgrades of any kind are required to meet the monthly click requirements. If click requirements are not met by members using upgrades your upgrade will be temporarily suspended. If your upgrade is suspended 3 times for this violation of terms, your account will be subject to cancellation.
AFFILIATE PAGES:
-- Affiliate Pages are offered as an extra earning feature.
-- Members with Affiliate Pages must click 100 clicks every calendar month (any combination of email, ptc..etc) with the minimum time set between clicks to be at least the minimum as set per ad and have $0.10 in personal earnings for each $1.00 in paid to promote, affiliate page, and downline earnings in order to request payout.
-- Affiliate Pages CANNOT be promoted in AUTO SURF EXCHANGES OR AUTO-URL ROTATORS SUCH AS AUTO CLICK EXCHANGES!
If the url has clickxsurf, surfclickxfinal, clicksurf or anything remotely like this, it will be deducted from your account. If I have to do this too many times, your affiliate page will be suspended. Thanks for understanding.
-- Affiliate Pages CAN be promoted in ways that offer manual clicking such as banner ads, text links, email ads, ptc ads, manual click exchanges or any means that allows a timer with a click for action to follow.
-- Affiliate Pages are currently paying 15c/1000 (subject to change).
PAID TO PROMOTE:
-- The Paid To Promote is offered as an extra earning feature for PAID UPGRADED MEMBERS ONLY.
-- Members using Paid to Promote Pages must click 100 clicks every calendar month (any combination of email, ptc..etc)with the minimum time set between clicks to be at least the minimum as set per ad and have 10% in personal earnings for each $1.00 in paid to promote, affiliate page, and downline earnings in order to request payout.
-- Paid to Promote Pages CANNOT be promoted in AUTO SURF EXCHANGES OR AUTO-URL ROTATORS!
-- Paid to Promote Pages CAN be promoted in ways that offer manual clicking such as banner ads, text links, email ads, ptc ads, manual click exchanges or any means that allows a timer with a click for action to follow.
-- The Paid to Promote is currently paying up to 40 cents per 1000 for upgraded members.
-- Members using the Paid to Promote Pages must click 100 clicks every calendar month (any combination of email, ptc..etc) with the minimum time set between clicks to be at least the mimumum as set per ad or member Paid to Promote privileges will be suspended. Once the member has clicked the 100 click requirement the Paid to Promote privileges will be reinstated after admin is contacted by the promoter. If members Paid to Promote privileges are suspended 3 times. On the third offense, members privileges for the Paid to Promote will be permanently terminated.
CHEATING:
Members who are caught cheating will have their account terminated and will forfeit their earnings.
Instances of cheating include the following:
*Clicking on 3 or more cheat links and your account is canceled.
*Caught using automated software to access the site.
*Having multiple accounts. Examples: same IP address/Payment Account/Computer ID.
*Fast clicking is not permitting the timer to run out before clicking on the next ad.
*Having 5 bad turing clicks will receive a warning, 10 bad turing clicks will cause your account to be suspended for a week, 15 bad turing clicks will cancel your account.
*Using the paid to promote feature if member is not a paid upgraded member: first offense is suspension for 30 days, second offense is account deletion.
*Having incorrect info listed in user's account
*Having bad interests selected in their accounts
*Having the free upgrade and clicking less than 50 links per calendar month
*Continually submitting (more than 3) of a 'banned site' for advertising. This means you can't read & write English and your account MAY be suspended, deleted, or penalized.
*Continually submitting 'unacceptable advertising' will get your account deleted.
***If you are caught cheating, your account at our site will be canceled. No exceptions.***
PAYMENTS:
Affiliates may earn by receiving paid-emails and visiting the advertiser websites
after they have entered their member ID in the area on the website provided by
TeddyBearClicks. Affiliates may earn by referring new affiliates to the
TeddyBearClicks
program. Affiliates will earn a percentage of advertising revenues collected by
TeddyBearClicks.
TeddyBearClicks
will pay affiliates when their balance reaches the minimum payout rate set by
TeddyBearClicks. Once the Tier 1 or 2 member has reached payout they may request payment. Payments will be made within 30 days or a reasonable time after.
Payouts are made via Paypal, and AlertPay or members can use earnings for advertisement.
Due to numerous bot users from China and India, no cash payouts are allowed to members from those countries.
***AlertPay payouts will be made according to available funds.
*Members from Tier 3 or 4 countries may only use their earnings for advertising as of March 1, 2011.
***Effective June, 2011***
Payouts of $3.00 minimum up to $5.00 maximum may not be requested more than once per calendar month by Tier 1 or 2 members only or paid upgraded members from Tier 3 or 4.
*** Effective July 17, 2010***
PTR Owners
Any Program Owner currently behind on payments (maximum of 60 days) and/or not answering support inquiries from their members MUST NOT request payout from teddybearclicks.com. If a payout request is received their account will be suspended until such time as their site is in order. Previous Program Owners of sites that have closed down without paying out members in full (including reimbursement of unused Upgrades and/or Affiliate Pages) will not be welcome.
CONVERTING POINTS TO CASH:
At this time there is no actual plugin for converting points to cash so points will be converted manually.
MEMBERS WHO ARE FROM REDEMPTION ONLY COUNTRIES WILL NOT BE ABLE TO CONVERT THEIR POINTS TO CASH ***ONLY CHINA AT THIS TIME***. If points are requested to be converted to cash and you are from a redemption only country, you request will be rejected.
RELATIONSHIP OF THE PARTIES:
You and
TeddyBearClicks
are independent contractors, and nothing in this Agreement creates any partnership,
joint venture, agency, franchise, sales representative or employment relationship
between you and
TeddyBearClicks. You understand that you do not have authority to make or accept any offers or
make any representations on behalf of
TeddyBearClicks. You may not make any statement, whether on your site or otherwise, that would
contradict anything in this section. You are solely responsible for the reporting
and payment of any taxes for money earned while using the program.
LIMITATION OF LIABILITY:
TeddyBearClicks
will not be liable for lost profits, lost business opportunities, or any other
indirect, special, punitive, incidental or consequential damages arising out of
or related to this Agreement or
TeddyBearClicks
program, even if
TeddyBearClicks
has been advised of the possibility of such damages. Furthermore,
TeddyBearClicks
aggregate liability arising under this Agreement will not exceed the amount of
the total fees paid or payable to you under this Agreement. The provisions of
this Section survive termination or expiration of the Agreement.
SPAM:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING),
newsgroup postings, or any other method of mass communication. Failure to comply
will result in immediate termination of your affiliateship with
TeddyBearClicks
and may result in legal prosecution.
TeddyBearClicks
strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member
caught Spamming will not only have their account terminated immediately and lose
any past, present and future earnings, but shall also be held liable for Spamming
as we shall cooperate with any authorities and investigations that may arise from
the Spamming incident.
TeddyBearClicks
may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for
immediate termination of all involved accounts. Signing up multiple times from
the same computer also constitutes fraud.
TeddyBearClicks
will file charges for recovery of any earnings received from multiple sign-ups.
